Man Sues Bank, Demands N5.5bn For Leaking Information That He’s Broke
A Kenyan businessman has dragged a domestic bank to court for allegedly leaking his confidential information to third parties without his consent.
Kirui Kamwibua, who owns New mega Africa Ltd is seeking damages of Ksh192 million as loss of income, Ksh1.2 billion for loss of goodwill, and Ksh92 million for the loss of fixed assets which amounts to Ksh1.48 billion (N5.5billion).
He filed a lawsuit before Mombasa Commercial Bank Admiralty court, and claimed that his data was leaked by an employee of Absa bank, thereby affecting his business operations negatively.
“As a result of the leakage, the plaintiff’s creditors and other suppliers descended upon him and interrupted the business operations,” Kamwibua said.
The CEO accused the bank and its employee of infringing on his right to privacy by disclosing confidential information to third parties.
He also said that failure to maintain the secrecy of his accounts by sharing his financial statements with strangers amounts to a breach of its common law of fiduciary duty.
Kamwibua also said that efforts to save his transport business by requesting the bank to restructure its loan obligations were ignored and resulted in financial sabotage
